Some of our products communicate with end users on behalf of our customers — for example, by sending scheduled text messages where the customer has collected appropriate consent from those end users. The terms below describe how that works and how we handle the information involved.

- OrthoMessage AI
- Software for clinical practices that delivers scheduled patient communications and routes patient responses back to the practice. Made available through participating practices under written agreement; not sold directly to patients.
Additional products are in development and are not publicly announced.
Messaging program terms
OrthoCentric AI operates software that sends SMS text messages on behalf of our customers. Messages are sent only to recipients who have provided prior express written consent to the customer who enrolled them. OrthoCentric AI does not market to consumers, does not purchase contact lists, and does not send unsolicited messages.
Program description
Enrolled recipients receive scheduled check-in messages and, where relevant, brief follow-up questions from the customer who enrolled them. Recipients may also receive transactional messages such as appointment reminders or instructional content related to a service they have already engaged with.
Message frequency
Frequency varies by customer program. A typical enrolled recipient receives between 1 and 5 messages per week during the first 6 weeks after enrollment, and fewer messages thereafter.
Opt-in
Patients of contracted orthopaedic surgical practices opt in to the SMS Program by signing a written consent form during a clinical encounter at the practice. The form explicitly states that:
- SMS consent is voluntary; and
- SMS consent is not a condition of receiving medical care, surgery, post-operative follow-up, or any other service from the practice.
A patient who declines SMS consent continues to receive identical medical care through telephone, patient portal, and in-person communication. The consent form also discloses the purpose and approximate frequency of messages and identifies OrthoCentric AI as the software platform delivering them. No recipient is enrolled without this signed consent. OrthoCentric AI does not operate any consumer-facing sign-up form.

Opt-out
Recipients can stop messages at any time by replying STOP to any message. Reply HELP for help. After replying STOP, no further messages will be sent from the program. Recipients may also opt out by contacting the enrolling customer directly or by emailing contact@orthocentricai.com.
Costs
Message and data rates may apply, depending on the recipient’s mobile carrier and plan. OrthoCentric AI does not charge recipients to receive messages.
Carriers and supported devices
Supported on all major U.S. carriers. OrthoCentric AI is not liable for delayed or undelivered messages caused by the recipient’s carrier or device.
Privacy
Mobile information collected as part of the messaging program is used solely to deliver and respond to program messages and is not shared with third parties or affiliates for marketing or promotional purposes. See the Privacy section below for full details.
Terms of Service

These Terms of Service (“Terms”) govern access to and use of software products and services made available by OrthoCentric AI, LLC (“OrthoCentric AI,” “we,” “us”). Specific products are made available to organizations (“Customers”) under separate written agreements that incorporate and may supplement these Terms.
Scope
These Terms apply to the use of our website, our software products, and any related services we provide. The messaging program described under Messaging program terms is subject both to these Terms and to that section, and to any Customer-specific agreement in effect.
Customer obligations
- The Customer is responsible for the lawful collection of any data (including phone numbers and consent records) submitted to our products.
- The Customer is responsible for obtaining and maintaining all consents, authorizations, and notices required for OrthoCentric AI to process that data on the Customer’s behalf.
- The Customer will use our products only for the purposes described in the applicable written agreement and will not use them to send unsolicited marketing messages, deceptive content, or content prohibited by applicable law or by mobile-carrier policies.
- The Customer will safeguard credentials issued to it and will promptly notify us of any suspected unauthorized access.
Fees
Fees, billing periods, and payment terms for a Customer’s use of our products are set out in the applicable written agreement between OrthoCentric AI and the Customer.
Intellectual property
OrthoCentric AI and its licensors retain all right, title, and interest in and to our products, including all software, designs, documentation, and derivative works. The Customer retains all right, title, and interest in and to data the Customer submits to our products.
Confidentiality
Each party will protect the other party’s confidential information using at least the same degree of care it uses to protect its own confidential information of similar importance, and in no event less than a reasonable degree of care.
Warranty disclaimer
Except as expressly stated in a written agreement between OrthoCentric AI and a Customer, our products and this website are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Limitation of liability
To the maximum extent permitted by law, OrthoCentric AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to these Terms or the use of our products or this website. OrthoCentric AI’s aggregate liability arising out of or relating to a Customer’s use of our products will be governed by the applicable written agreement between the parties.
Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. The state and federal courts located in Maryland have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and the parties consent to personal jurisdiction in those courts.

We may update these Terms from time to time. The effective date above indicates when they were last revised. Material changes will be communicated to active Customers.

Privacy policy

OrthoCentric AI, LLC (“OrthoCentric AI,” “we,” “us”) operates software under contract with its customers (“Customers”). This Privacy Policy describes how we handle information collected through our software platform and this website.
Information we process
- Recipient identifiers provided by the Customer (such as name, mobile phone number, and any identifiers the Customer uses to manage its own records).
- Recipient responses to scheduled messages, including any free-text replies sent.
- Message delivery metadata from our SMS provider (delivery status, timestamps, error codes).
- Website analytics at the visit level (page, referrer, approximate region, browser). We do not place advertising cookies on this site.
How we use information
- To deliver scheduled messages to recipients enrolled by the Customer.
- To route recipient responses back to the Customer for review.
- To respond to opt-out (STOP) and help (HELP) requests.
- To maintain audit logs required by law or by our agreement with the Customer.
- To diagnose technical errors in message delivery.
Role of the Customer
OrthoCentric AI processes recipient information only as instructed by, and on behalf of, the Customer that provided it. Where the Customer is subject to a sector-specific data protection regime (for example, the U.S. Health Insurance Portability and Accountability Act), OrthoCentric AI executes a written data processing or business associate agreement with that Customer and processes information accordingly.
Sharing
We do not sell, rent, or share recipient information for marketing or advertising. We share information only with: (a) the Customer that provided it; (b) infrastructure subprocessors (database hosting, SMS delivery, transactional email) under written data processing terms; and (c) regulators, courts, or other parties where required by law.
Mobile information is never shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information exclude mobile opt-in data and consent; this information is not shared with any third parties.
Retention
Recipient messaging records are retained while the Customer’s engagement with OrthoCentric AI is active and for any period required by applicable law or the Customer’s recordkeeping obligations thereafter. Recipients may request earlier deletion by contacting the Customer that enrolled them; deletion is honored subject to law.
Security
OrthoCentric AI uses encrypted transport (TLS) for all data in transit and encryption at rest for stored data. Access to recipient information is limited to authorized personnel of the Customer and a small number of OrthoCentric AI staff under role-based access controls and audit logging.
Recipient rights
Recipients may exercise any rights they have under applicable law by contacting the Customer that enrolled them. We will support the Customer in responding to any such request.

Compliance

This section describes OrthoCentric AI’s approach to security and regulatory compliance at the corporate level. Product-specific commitments are set out in the applicable written agreement with each Customer.
Regulatory posture
Where a Customer is subject to a sector-specific data protection regime — for example, the U.S. Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations — OrthoCentric AI enters into a written business associate agreement (BAA) with that Customer and processes the Customer’s data only in accordance with that agreement and the law. OrthoCentric AI is also subject to applicable U.S. state privacy laws and U.S. mobile-messaging regulations, including TCPA and mobile-carrier A2P 10DLC requirements.
Security baseline
- Encrypted transport (TLS) for all data in transit.
- Encryption at rest for stored Customer data.
- Role-based access controls and least-privilege provisioning.
- Multi-factor authentication required for administrative access.
- Audit logging of access to Customer data and of privileged operations.
- Regular review of access, secrets, and third-party dependencies.
- Incident response and Customer notification procedures consistent with applicable agreements and law.
